General Terms and Conditions for the Services Provided by Werre-Quartier Betriebs UG (Limited Liability) & Co. KG to Individual and Corporate Guests (Based on the Recommendations of the German Hotel and Restaurant Association – DEHOGA)

I. Conclusion of the Contract

1. The contract is concluded in accordance with these Terms and Conditions as soon as the room(s) or other services are booked and confirmed. Whenever possible, the Privathotel Stickdorn will confirm the reservations to the guest in writing.

2. The contracting parties are the guest and the hotel. If a third party has made a reservation on behalf of the guest, that third party is jointly and severally liable with the guest to the hotel for all obligations arising from the hotel accommodation contract, provided the hotel has received a corresponding statement from the third party.

3. When registering multiple people—particularly for group, travel, seminar, and conference events—participant lists must be submitted to the hotel in writing as follows:
a. Notifications regarding the estimated number of attendees must be submitted up to 28 days prior to arrival
b. Specific room assignments or the exact number of attendees must be provided up to 14 days prior to the arrival date
c. Events of a political nature or involving religious sects must be clearly identified as such at the time of registration

4. If the content of the reservation confirmation differs from the content of the booking request, the differing content of the confirmation becomes binding on the guest and the hotel only if the guest does not expressly object within 7 days of receiving the reservation confirmation. This applies only if the reservation confirmation contains an explicit statement that, in the event the aforementioned deadline is missed, the differing content of the reservation confirmation becomes a valid part of the contract.

II. Room Reservations by an Individual Guest

1. For room reservations made by an individual guest, the provisions set forth below in Section II shall apply in addition to the provisions in Sections I, III, V, VI, and VII of these General Terms and Conditions. The provisions in Section IV of these General Terms and Conditions do not apply to room reservations made by individual guests. An individual guest is a person who books a hotel room in their own name and at their own expense without ordering any other services from the hotel and without claiming special rates for the room reservation—such as those offered to tour operators, group travelers, or for package deals, etc.

2. The conclusion of the lodging agreement obligates the contracting parties to perform the agreement, regardless of the term for which the agreement was entered into. This contract cannot be terminated unilaterally, unless one of the contracting parties has the right to terminate the contract due to default, impossibility attributable to the other party, or for good cause.

3. Reserved rooms are available to guests starting at 2:00 p.m. on the day of arrival. On the agreed-upon day of departure, guests must vacate their rooms and return them to the hotel by 12:00 p.m. at the latest. Thereafter, the hotel may charge 80% of the current daily rate for continued use of the room until 6:00 p.m., and 100% after 6:00 p.m. The guest is free to provide evidence that the aforementioned claim did not arise or did not arise in the amount claimed.

4. Unless a later check-in time has been expressly agreed upon, the hotel reserves the right to reassign reserved rooms after 6:00 p.m.

5. The guest has no right to be provided with specific rooms or accommodations. If the agreed-upon accommodations are not available, the hotel is obligated to make every effort to provide an equivalent substitute on the premises or at other locations.

6. If the period between the conclusion of the contract and its performance exceeds four months and the price generally charged by the hotel for such services increases, the hotel may raise the contractually agreed price by a reasonable amount, but by no more than 5%. In the event of a price increase, the guest is entitled to an extraordinary right of termination.

7. If the guest does not make use of the contractual services, the guest is obligated to pay the agreed-upon price or the standard rate, less any expenses saved by the hotel. Based on experience, these savings amount to 20% of the room rate for lodging and 30% of the normal prices for food and beverages. The guest is free to provide evidence that the aforementioned claim did not arise or did not arise in the amount claimed.

8. The hotel is obligated, in good faith, to re-rent unused rooms and facilities whenever possible in order to avoid losses. Until such rooms or facilities are re-rented, the guest must pay the amount calculated in accordance with Section II.7 for the duration of the contract.

III. Prices and Payment Terms

1. The agreed-upon prices include the applicable value-added tax. In the event of a change in the value-added tax rate, we reserve the right to adjust the prices.

2. The hotel may change the rates if the guest subsequently requests changes to the number of rooms booked, the hotel services, or the length of the guests’ stay, and the hotel agrees to such changes.

3. All amounts owed to the hotel become due upon the guest’s or event organizer’s departure and, unless otherwise agreed, must be paid on site.

4. If invoicing is agreed upon in advance in writing, the remaining total amount due is payable without deduction within 7 days of the invoice date. In the event of late payment, the hotel is entitled to charge the applicable late payment interest, currently 5% above the base rate, or 3% above the base rate for legal transactions involving a consumer. The hotel reserves the right to prove higher damages, and the guest reserves the right to prove lower damages. In the event of late payment, the hotel is also entitled to terminate the contract and resell the agreed-upon rooms. The provision in Section II.7 remains unaffected.

5. The place of performance for these payment obligations remains the hotel’s registered office, even if, for example, the claims are credited pursuant to special agreements or become due at a later date based on agreed billing terms.

6. For bookings of packages at our hotel, the hotel may charge a 100% deposit, payable immediately. This is at the hotel’s discretion and is based on a case-by-case decision.

IV. Cancellations/Changes

1. All cancellations or changes not covered by Section II of these General Terms and Conditions must in all cases be made in writing; however, they do not relieve the guest of the obligation to pay the agreed-upon or standard rates. The following applies to lump-sum compensation for rooms, as well as for events and the provision of facilities:

1. The cancellation policy stated on the reservation confirmation applies.
2. Unless a written cancellation confirmation is provided in advance, free cancellation is permitted up to 6:00 p.m. on the day before arrival; after that, 90% of the total price will be charged. If you do not cancel or fail to arrive, we will charge 100% of the total price.
3. For special events, the hotel reserves the right to impose separate cancellation policies.

V. Damages and Liability

1. The hotel’s contracting parties, or the guest as such or as a host, are fully liable to the hotel for any damage caused by themselves or their guests.

2. If the hotel is prevented from fulfilling its obligations due to force majeure, illness, a strike, or similar circumstances, the hotel shall not be liable for damages; however, the hotel is obligated to the client to make every effort to arrange for equivalent services from another provider.

3. To the extent that the hotel procures third-party services, technical equipment, or other facilities from third parties on behalf of the organizer, it acts in the name and on behalf of the organizer. The guest is responsible for treating these items with care and returning them in proper condition, and shall indemnify the hotel against all claims by third parties arising from the provision of these items. The guest is responsible for obtaining any necessary insurance for exhibition items, technical equipment, or other items brought to the venue.

4. The hotel shall be liable for its obligations under the contract with the diligence of a prudent businessperson. The guest’s claims for damages are excluded. This does not apply to damages resulting from injury to life, body, or health; loss of liberty; or violation of sexual self-determination, if the hotel is responsible for the breach of duty, as well as other damages resulting from an intentional or grossly negligent breach of duty by the hotel and damages resulting from an intentional or negligent breach of the hotel’s obligations typical to the contract (so-called cardinal or core obligations). A cardinal obligation is an obligation whose fulfillment is essential to the proper performance of the contract and on whose observance the other party to the contract regularly relies and is entitled to rely. Furthermore, mandatory liability under the Product Liability Act, liability arising from a guarantee assumed by the hotel, and the hotelier’s liability pursuant to Section V.5 of these General Terms and Conditions remain unaffected. A breach of duty by the hotel is deemed equivalent to a breach of duty by a legal representative or agent. Should any disruptions or deficiencies arise in the hotel’s services, the hotel will make every effort to remedy the situation upon becoming aware of them or upon receiving an immediate complaint from the guest. The guest is obligated to do everything reasonably possible to remedy the disturbance and minimize any potential damage.

5. The hotel is liable to the guest for personal belongings brought onto the premises in accordance with statutory provisions, i.e., up to 100 times the room rate, with a maximum of 3,500.00 euros, and for cash, securities, and valuables up to 800.00 euros. Cash, securities, and valuables may be stored in the hotel or room safe up to a maximum of 7,500 euros, which is the insurance coverage amount designated for the respective hotel. The hotel recommends that guests take advantage of this opportunity. Claims for liability shall be barred unless the guest notifies the hotel immediately upon becoming aware of the loss, destruction, or damage. These provisions regarding the statutory liability of hotels and restaurants apply accordingly to any further liability on the part of the hotel.

6. The installation of decorative materials or similar items, as well as the use of areas in the hotel outside the rented or agreed-upon rooms, requires the hotel’s written consent and may be subject to the payment of an additional fee. These and any other items brought in by the guest must comply with local fire safety and other regulations. The guest agrees to clear all used areas at the end of the event and to restore them to their original condition as rented. This does not affect the hotel’s right to claim damages.

7. Messages, mail, and packages for guests will be handled with care. The hotel will store your items (on the premises) and, upon request, forward them to you for a fee. The limitations of liability set forth in Section V. 4 of these General Terms and Conditions apply.

8. The hotel will carry out wake-up calls—provided they have been properly requested—with the utmost care. The limitations of liability set forth in Section V. 4 of these General Terms and Conditions apply.

9. If a guest is provided with a parking space in the hotel parking lot, this does not constitute a contract of safekeeping. In the event of loss or damage to motor vehicles parked or maneuvered on the hotel premises and their contents, the hotel shall be liable only in accordance with the limitation of liability set forth in Section V. 4 of these General Terms and Conditions.

VI. General Information

1. The hotel provides tourist information and other information of all kinds to the best of its knowledge, but without guarantee. Personal data is generally subject to the Data Protection Act; the hotel does not provide any information regarding this matter.

2. Lost and found items (items left behind) will be sent only upon request and with payment due upon delivery. The hotel agrees to store the items for 2 months. After that date, the items will be disposed of.

3. With regard to the carriage of passengers and baggage, the provisions of Section V apply. 4. The limitation of liability agreed upon in these General Terms and Conditions.

VII. Final Provisions

1. The most recent price changes and the latest version of our Terms and Conditions apply.
2. We reserve the right to correct errors, as well as printing and calculation errors. Any deviating agreements or verbal arrangements shall not take effect until they have been confirmed in writing by the hotel. This applies in particular to the waiver of the written form requirement.
3. Should any of the above provisions be invalid, this shall not affect the validity of the remaining provisions.
4. The place of jurisdiction shall be deemed to be the registered office of the company, Werre-Quartier Betriebs UG & Co KG, if the guest is a merchant and no other exclusive place of jurisdiction for the legal dispute is prescribed by law. However, the hotel is also entitled to file a lawsuit at the guest’s place of residence.
